Acceptance of Terms
By downloading, installing, or using MobileMountaineer ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.
Description of Service
MobileMountaineer is a fishing companion app that provides lure, technique, and timing recommendations based on weather, barometric pressure, solunar data, and target species. The App is provided for informational and recreational purposes only.
Subscriptions
MobileMountaineer offers an optional auto-renewable subscription ("MobileMountaineer Pro") that unlocks additional features including personalized lure scoring, state fishing regulations, tournament mode, and more.
- Payment is charged to your Apple ID account at confirmation of purchase.
- The subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
- You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. Weather data, fishing recommendations, solunar predictions, and regulation information are provided for general guidance only.
- Weather data is sourced from Apple WeatherKit and may not reflect real-time conditions at your exact location.
- Fishing regulations displayed in the App are for reference only. You are responsible for verifying current regulations with your state wildlife agency before fishing.
- Severe weather alerts are informational. Always monitor official sources (National Weather Service) and use your own judgment regarding personal safety.
Limitation of Liability
To the fullest extent permitted by applicable law, Russell White shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.
User Conduct
You agree to use the App only for lawful purposes and in accordance with all applicable local, state, and federal laws, including fishing regulations and licensing requirements in your jurisdiction.
Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the property of Russell White and are protected by applicable intellectual property laws.
Third-Party Services
The App uses Apple WeatherKit for weather data and Apple HealthKit for optional heart rate reading. Your use of these services is subject to Apple's terms and conditions. The App also uses data from the U.S. Geological Survey (USGS) for water level information.
Changes to These Terms
We may update these Terms of Use from time to time. Changes will be posted on this page with an updated effective date. Continued use of the App after changes constitutes acceptance of the updated terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
